Please read these Terms of Service ("Terms") carefully before using the Card Mogul mobile application (the "App") operated by Sam Gabbay ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using Card Mogul, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App after any changes constitutes acceptance of the updated Terms.

2. Description of Service

Card Mogul is a free-to-play multiplayer card game. The App allows users to play card games in real time with other players, track their rankings on leaderboards via Apple Game Center, and receive push notifications about game events. The App is available on iOS devices.

3. User Accounts and Conduct

You access Card Mogul through your Apple Game Center account. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account.

All content, features, and functionality of the App -- including but not limited to the design, graphics, user interface, code, and trademarks -- are owned by Sam Gabbay and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the App without our prior written consent.

Card Mogul is an independent product created by Sam Gabbay.

5. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Sam Gabbay be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of or in connection with your use of the App.

In no event shall our total liability to you for all claims arising out of or relating to the App exceed the amount you have paid us in the twelve (12) months prior to the event giving rise to the liability, or $50 USD, whichever is greater.

7. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of such courts.

9. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
